Terms and Conditions of Sale.
The following terms and conditions apply to Equinox Group Stores.
The terms "you", "your" and "yours" refer to the customer/purchaser, purchasing services or merchandise ("Product"). The terms "we", "us" and "our" refer to Equinox Electronics, Equinox Computers, Equinox Group Stores. These terms and conditions apply to purchases made at our stores.
Returns and Refunds Purchases
In Store Returns
General
Merchandise Returns
Most merchandise purchased may be returned to any Equinox Group stores provided
the Product is accompanied with its original box, packaging, all manuals and
accessories, and no sign of physical damage or misuse is noted, within 14 days from
product purchase date. We will
replace or repair, at our sole discretion, any product that is deemed defective. Returns for promotional
or discounted or special deals terms are exempted, however items sold under
these special deals may be exchanged if defective. for a similar valued product.
No cash exchange will be given.
Computers and
Related Merchandise Returns
Most Computers and related merchandise (Except for printers, see below)
may be returned if accompanied with the original box, packaging, all manuals and
accessories within 14 days from Product receipt. There is a 15% open box fee for
the return of computers build to order (assembled) and digital cameras that are
opened or in a non-factory sealed box unless exchanged for that exact item.
Opened CD's, cassette tapes, prerecorded videos and computer-related software
may only be exchanged for the exact same item and only if the original
merchandize is defective. Any computer or related merchandise returned
during the applicable return period, which is defective, will be exchanged for
the exact same model at no additional charge to you.
Printers and Related Merchandise Returns
Unless the printer is defective, we regret that no return will be accepted after the printer has been used with the ink cartridge or the laser toner inserted.
In all cases, any merchandize is damaged due to misuse will not be accepted. When returning Product to your local Equinox Group Store, please be sure to bring the credit card used for the purchase along with your receipt, if credit card is used. Credits will only be issued to the credit card used for the original purchase. You must also produce the original receipt , without which we regretfully will not accept the returned merchandise. We will not accept returned merchandise that has any missing accessories nor will we entertain any claims from customers that those accessories were not in the original package. In case the merchandise is damaged or not in fully working order and accessories are not returned, then the value of missing accessories and any applicable open box fee will be deducted from the credit amount of the return. Shipping fees are non-refundable whether an item is returned to our stores or to our Service Center.
Mail Returns
General
Merchandise Return Policy
Merchandise purchased on-line through our website
www.eqxgroup.com (regardless of
whether you picked it up at a store or had it delivered to your home), which
meets the return guidelines above, may be returned via mail or courier to our authorized
return center. Before returning anything by mail to us, you must first obtain a
Return Material Authorization ("RMA"). Please call us for an RMA.
Please note you will be responsible for all shipping and insurance charges for returns, unless otherwise indicated. If you choose not to insure your package, and we do not accept return of the Product for reasons stated above, you will be responsible for any loss or damage. The purchase price (less any applicable open box fees) will be credited to your credit card account upon our acceptance of the merchandise in like new condition in conformity with this policy. Shipping fees are non-refundable whether an item is returned to our store or to our Service Center.
Please allow 14 days from when we receive your Product for the processing of your credit. Additional charges may be assessed for Products returned with any missing parts and/or accessories.
New Product
Manufacturer's Warranties
You are entitled to the
manufacturer's limited warranty, if any, that accompanies the product. Most new Products are sold with the manufacturer's limited warranty.
Equinox Group makes no additional
or independent warranty. All other warranties, express or implied, including the
warranties of merchantability and fitness for a particular purpose are
disclaimed.
The warranty
periods and service varies by manufacturer and Product. Equinox Group
shall under no circumstances be liable for
special, incidental, or consequential damages including loss of profit, even if
it has been advised of the possibility of such damages; the maximum liability
for all direct damages, if any, arising out of any action shall be limited to an
amount not to exceed the purchase price of the product.
The full text of any
such warranty is normally accompanied by the merchandise. Please note that it is
the customer responsibility to fill and submit the warranty card to the
manufacturer. In some cases, failure to register the product, could lead to the
manufacturer declining any warranty claims. We will be glad to assist you in
completion of this procedure at Equinox Group Stores,
Performance
Guarantee
Due to the diversity of the products that we sell, and means of usage, we regret
the fact that we can not offer our customers the assurance that the mechanize
they purchase meets with their own performance criteria. Most of the merchandises have
specification printed on the retail box or separately in form of brochures,
leaflets or user manual. Equinox Group can provide Performance Guarantee to the
letter of these documents but not beyond. We can not assure compatibility with
other products, nor are we in a position to enhance the product beyond its
intended performance criteria.
The customer must ensure that he/she is aware of the performance of the merchandise and meets his/her performance level. We will not be held liable or responsible for claims that wrong or inaccurate advice has been provided by our staff, and we will not indulge in arguments created by verbal discussions between the staff and the customer as a results of customer dissatisfaction with the product and/or claims that performance assurance was given verbally by our staff.
Computer
Support Plus
For computers & related products, we proudly offer our optional Computer Support
Plus Service in addition to the manufacturer warranty. Benefits of our Computer
Support Plus include:
· In-home service for covered products provided by a network of qualified service technicians.
· On site service in your home (for many covered products). Express exchange service is provided for other covered products.
· Elimination of costly repair bills for 3 years AFTER your manufacturer warranty expires!
· Power surges are covered from day one of ownership.
· Your computer is replaced if it is not repairable!

Rent-to-Own
scheme.
This scheme is applicable to in-store sales at Equinox Group Stores and does not
apply to On-Line sales. The payment must be regularly continued under the
rent-to-own agreement. Under no circumstances will we accept stopping the
monthly payment due to malfunction of the merchandize, or due to disputes in the
warranty terms that are covered under separate terms and condition. For more
details , refer to the Rent-to-own agreement.

Disclaimer of
warranty for Equinox Group site
We provide our site and its contents on an "AS IS" basis and make no warranty or
representation regarding any Product or service, either express or implied,
including the warranties of merchantability, fitness for a particular purpose,
and non-infringement, unless otherwise stated herein. Prices, when quoted, are
subject to change without notice.
Limitations
and Exclusions
We reserve the right to change prices, terms, specifications and warranties
without notice. We endeavor to accurately describe every Product offered for
sale; however, mistakes can sometimes be made. Any typographical, photographic,
or specification error in Product description, pricing or offers is subject to
correction and verification. Monitor displays are simulated. Monitors are not
included with computer systems unless specified. On-line sales are intended for,
and limited to, personal use and domestic sales only. If you are purchasing
Products for export, you are responsible for the necessary export documentation
before shipment is made to a foreign country. Warranties for exported products
may vary or be null and void. We reserve the right to limit the number of
Products sold, including the right to prohibit sales to re-sellers. Prices do
not include shipping, tax and insurance.
Damages
In no event shall Equinox Group, its subsidiaries or affiliates, or their
respective officers, directors, employees, representatives or agents be liable
for special, incidental, consequential, punitive, indirect, or other special
damages, including but not limited to, loss of data, use, or profits, however
caused, whether for breach of contract, negligence, or otherwise, and whether or
not we have been advised of the possibility of any such damages.
Miscellaneous
We may revise these terms and conditions at any time by updating the Equinox
Group web site. These terms and conditions are governed and construed by the
laws of the Sate of Bahrain without regard to its conflict of law rules. You
agree that if any part of these terms and conditions are found to be
unenforceable, the remainder of these terms and conditions will remain in full
force and effect.
Customer
Acknowledgment.
By virtue of buying a product
from Equinox Group, the customer acknowledges agreement with these Terms of
Sale. All products are sold under these terms without exception.
Vendor License
Agreements.
Customer agrees to abide by all
license provisions or end user agreement imposed by the manufacturer or
publisher including any copyright laws applicable in state of Bahrain or
internationally.
Exclusive
Agreement.
These Terms of Sale represent the complete and final agreement between the
Customer and Equinox Group for the matters set forth herein, and shall be
supplemented only by the prices, quantity, and descriptions set forth in Equinox
Group's invoice for the relevant sale. Terms contained in Customers' purchase
orders, offers to buy, terms and conditions, and the like shall have no effect.
Trademarks and
Service Marks
Equinox Group logo is a registered trademark of Equinox Group and may not be
used without permission. All other trademarks are the property of their
respective companies and are used with permission.
